Kathy Aparo-Griffin Every single seller that is in Default and has missed "ONE" payment ALWAYS asks this question. For some reason sellers think that the "BANK," can pull them out of their homes, put their personal belongings on the curb and lock them out of their homes. THIS IS SIMPLY NOT THE CASE!!!
Before I continue let me say that WE ARE NOT ATTORNEYS and IF YOU ARE IN DEFULT or CONSIDERING a SHORT SALE YOU ARE STRONGLY ADVISED TO CONSULT A REAL ESTATE ATTORNEY.
In my years of experience as Delands Short Sale Specialist I can tell you the lender has to do things LEGALLY that means the "proper" steps when a borrower is in default. Among those procedures are:
Petition to Foreclose
Notice of Lis Pendens
Twenty Day Summons
Motion for Summary Final Judgment
Notice of Filing
Final Order/Judgment of Foreclosure
Notice of/for sale
Proof of Publication
We have some short sales that have taken up to 3 years yes that is correct 3 YEARS! The shortest time we have ever short sold a property is about 3 months. During this time the SELLER/AKA the Borrower has stayed in the property. As long as the property is "preserved and secured" the banks WILL MOST LIKELY NOT REKEY. ReKEY means that the property is secured by the bank allowing PRESERVATION to begin. That is where the bank "hires" a company to "check on the property," weekly or sometimes montly.
Just remember as the BORROWER even if your in default the LENDER still needs to do things legally. That means a VERY LONG PRCEDURE KNOWN as FORECLOSURE. So don't feel you need to move out PRONTO...you have tiime PLENTY of time!

Kathy Aparo-Griffin We have helped many many folks facing forclosure and MANY MANY times we get asked ...should I leave, I've missed one payment??
There are some that have an uneasy feeling about staying because "they are NOT paying their mortgage."
Let me say that "staying" helps and here is why...When you move out during a short sale many times the home is left to be broken into, the pool turns green and in florida if the AC is NOT running then you get into mildew issues and problems, not to mention the grass gets high and then the city imposes "CODE ENFORCEMENT FINES," here is Delightful deland they can be $250 PER DAY for each day the grass is TOO HIGH.
So take a deep breath and dont' get all worked up about having to "MOVE" as soon as you miss that first payment. Your helping preseve the condition of the property and helping to make it easier to sell by staying.
Some lenders thru the HAFA program are offering relocation assistance of up to $3000 but it has to be or have been your primary residence in the PAST 12 MONTHS( DEC 2010 UPDATE on HAFA)
So should you stay or should you go?? It makes everyones life "easier" if you can stay until the property is SOLD.

Kathy Aparo-Griffin Many times we get asked this question from buyers relocating to the area that have children. My personal preference is a small student/ teacher ratio and for that reason my daughter attends the Sanctuary located on Taylor Road. Her 3rd class consists of 5 students!! .The one on one she gets is Amazing, she is far advanced for her age. They are doing algebra and she can read anything that you toss at her.
